About The Settlement

1. Why did I receive this Settlement Payment?

Your settlement payment is the result of a settlement in the lawsuits— McPherson v. American Bank Systems, Inc., and Lyles v. American Bank Systems, Inc.

The lawsuits asserted claims on behalf of a class of individuals related to the Data Security Incident and ABS’s data security practices. These claims include alleged negligence, negligence per se, violations of Oklahoma’s unfair and deceptive trade practices statute, unjust enrichment and seek injunctive and declaratory relief. ABS denies these allegations, any wrongdoing, and that it is liable in any amount to the affected individuals.

The parties agreed to a settlement to resolve the Lawsuit. The Court did not decide whether ABS violated the law.

2. Who received a settlement payment from the settlement?

Eligible class members who timely returned valid claim forms were sent settlement payments.

If you chose to receive your settlement payment by check, please cash your check by November 2, 2023 or it will be void.

If your address changed recently, send an email with your name, your old address and new address to info@ABSdatasecurityincidentsettlement.com or call the Settlement Administrator toll-free at 866-387-1743.

3. How do I get a settlement payment?

To receive a settlement payment, you must be a Settlement Class Member and have completed and submitted a timely and valid Claim Form.

It is too late to submit a Claim Form now.

4. I need my check reissued. What should I do?

To request a check reissue, write to the Settlement Administrator at:

5. Is it too late to receive a settlement payment if I did not timely submit a claim form?

Yes, it is too late. If you did not previously complete and return a claim form by the deadline set by the Court, you are not eligible to receive a settlement payment. No exceptions can be made.
